Terms & Conditions (UK & IE)


1. About the Promoter and Nature of the Business

Mammoth Giveaways Ltd (the "Promoter") is a registered company in Northern Ireland under company number NI727683. Our registered office is Suite 4000-4025, 6 Margaret Street, Newry, County Down, BT34 1DF, Northern Ireland. All correspondence should be directed to info@mammothgiveaways.com. These Terms & Conditions govern all competitions operated by the Promoter on its website (the "Website").

Mammoth Giveaways competitions are based on skill. Entry is only valid when participants submit a correct answer to the competition question. While promotional materials may also refer to terms such as “Win” “Giveaways” or “Draws”, all entries must meet the skill requirement to qualify.

2. Eligibility to Enter

  • 2.1 Entrants must be 18 years or older at the time of entry and legally entitled to participate in competitions under their local laws.
  • 2.2 Employees, contractors, and immediate family members of Mammoth Giveaways Ltd or associated companies are prohibited from entering.
  • 2.3 The Promoter reserves the right to verify eligibility at any time. Failure to provide satisfactory proof of eligibility may result in disqualification without refund.
  • 2.4 It is the responsibility of the entrant to ensure that participation does not contravene any laws applicable in their jurisdiction.
  • 2.5 Skill Requirement
    All entrants must correctly answer the skill-based Competition Question to be eligible to win. Entries with incorrect or blank answers will be excluded from the draw.
  • 2.6 Verification of Eligibility
    The Promoter reserves the right to request proof of age, identity, residency, and/or correct answer at any time. Failure to provide satisfactory documentation may result in disqualification.
  • 2.7 Right to Refuse or Terminate Entry
    The Promoter reserves the right to reject or remove entries and/or terminate a participant’s involvement in any competition if they:
    • breach these Terms & Conditions,
    • provide false or misleading information,
    • attempt to manipulate or unfairly influence the competition,
    • or are otherwise deemed ineligible or unfit to participate.

3. How to Enter

  • 3.1 Entry to any competition is available via:
    • (a) selecting an active competition on the Website;
    • (b) answering the Competition Question correctly;
    • (c) purchasing at least one entry ticket.
  • 3.2 Each correctly submitted and paid entry constitutes one valid entry.
  • 3.3 Free entry is available by post. To qualify:
    • (a) send a clearly handwritten postcard with your full name, address, phone number, email address, date of birth, competition name, and your answer to the Competition Question to our registered office;
    • (b) each postcard must be submitted separately via first or second class post. Bulk entries in a single envelope will be counted as one.
  • 3.4 Entries received after the Closing Date will not be included. Proof of posting does not constitute proof of delivery. Free entries must also comply with all conditions as if they were paid entries.
  • 3.5 The Promoter does not acknowledge receipt or confirm the validity of free postal entries. Responsibility for timely and correct submission lies with the entrant. Late, illegible, or incomplete entries will not be accepted.
  • 3.6 Entry Confirmation
    Entrants are encouraged to keep a record of all submitted entries, including any confirmation email or payment receipt. The Promoter does not issue manual confirmation for free entries but will consider evidence of valid posting where system faults arise.

4. Competition Timings

  • 4.1 Each competition will state an Opening Date and a Closing Date, both of which are displayed on the Website.
  • 4.2 The Promoter reserves the right to extend or shorten the competition period at its discretion. Any changes will be publicly communicated on the Website.
  • 4.3 Once closed, no further entries will be accepted. Competitions cannot be reopened under any circumstance unless otherwise notified in advance.

5. Winner Selection and Notification

  • 5.1 All valid entries will be assigned an entry number. The winner will be drawn at random using a trusted independent random number generator (e.g., random.org).
  • 5.2 The draw will be live-streamed and posted after for audit purposes and transparency.
  • 5.3 The winner will be contacted using the details provided at entry. If the winner does not respond within 14 days, the Promoter reserves the right to redraw the prize.
  • 5.4 The surname and general location of the winner may be published, unless the winner requests confidentiality in writing prior to the Closing Date.
  • 5.5 The Promoter may be required to share winner details with regulatory authorities to demonstrate fairness and compliance.
  • 5.8 Draw Rescheduling Policy
    The Promoter reserves the right to bring the draw date forward or delay it by up to 7 days, up to 3 times after the first rescheduling, where reasonably necessary. This may be due to technical issues, external delays, event partner requirements, or other valid operational reasons. All schedule changes will be clearly posted on the Website and/or social media channels. Entrants are advised to check competition pages for updates. Free postal entries received after a revised draw date may not be included.
  • 5.9 Live Draw Validity
    All live draws are conducted using independently verified systems and are recorded or streamed for transparency. The results of any draw are final unless a technical error is confirmed during or immediately following the broadcast.

6. Prize Information and Substitutions

  • 6.1 Prizes are clearly described on the competition page. Images are for illustrative purposes only.
  • 6.2 In the event a prize is unavailable due to circumstances beyond the Promoter’s control, a similar prize of equal or greater value will be offered. Alternatively, the winner may choose a cash alternative up to 70% of the prize value, where stated.
  • 6.3 All cash prizes will be paid to the winner's verified bank account. Identity and ownership verification may be required.
  • 6.4 Prizes are non-transferable, non-exchangeable, and cannot be substituted for other goods or services unless stated by the Promoter.
  • 6.5 Any tax liability or cost related to prize acceptance remains the responsibility of the winner.

7. Travel, Events & Experience Prizes

  • 7.1 Where a prize includes travel, accommodation, or event tickets, the winner is responsible for obtaining valid passports, visas, insurance, and meeting entry or travel requirements.
  • 7.2 Unless explicitly stated, travel insurance, meals, visas, vaccinations, and other incidentals are not included.
  • 7.3 In the event of cancellation by third-party suppliers (e.g. airlines or venues), the Promoter is not liable to provide alternatives beyond what is reasonably available.
  • 7.4 Travel Liability Disclaimer
    The Promoter is not responsible for any injury, illness, loss, damage, death, delay, or expense incurred by the winner or their guests during travel, accommodation, or event attendance related to the prize. This includes, but is not limited to, acts or omissions by third-party providers such as airlines, hotels, transport services, or venues. The winner is solely responsible for arranging adequate travel insurance and complying with all travel and entry requirements.

8. Publicity and Image Rights

  • 8.1 By entering a competition, entrants agree that the Promoter may use their name, likeness, photographs, or recordings in promotional materials, unless they opt out in writing.
  • 8.2 Opting out will not affect your entry eligibility or prize award.
  • 8.3 Any promotional content produced by or for the Promoter remains the sole intellectual property of Mammoth Giveaways Ltd.

9. Refunds and Cancellations

  • 9.1 Refunds are only issued where a competition is cancelled by the Promoter or if an entrant has been mistakenly charged multiple times due to a technical fault.
  • 9.2 No refunds will be issued for valid entries or missed entries due to user error.
  • 9.3 The Promoter reserves the right to cancel any competition that does not meet minimum participation levels. In such cases, full refunds will be processed within 14 days.

10. Technical Disruption and Fair Play

  • 10.1 The Promoter commits to ensuring all draws are fair and transparent.
  • 10.2 If a system failure or other technical disruption compromises competition integrity, the Promoter may suspend, cancel, or reschedule the competition.
  • 10.3 Users found to be tampering with systems or using bots or other unfair means will have their entries voided and accounts terminated without refund.
  • 10.4 Entry System Integrity
    Only entries successfully stored in our platform database will be treated as valid. If technical issues occur, the Promoter may accept documented proof of attempted entry. Reasonable measures will be taken to resolve major issues within 48 hours. If an issue extends beyond this period, a backup entry method may be made available.

11. Data Handling and Protection

  • 11.1 Personal data provided by entrants is processed in accordance with the Promoter's Privacy Policy.
  • 11.2 Data is only used to administer the competition, process entries, notify winners, and meet legal obligations.
  • 11.3 Entrants have the right to access, correct, or delete their data at any time by contacting info@mammothgiveaways.com.

12. Changes to These Terms

  • 12.1 These Terms & Conditions may be updated at any time without prior notice.
  • 12.2 The latest version will always be available on the Website. Entry into a competition indicates acceptance of the most current version.
  • 12.3 The current version of these Terms & Conditions is effective as of 23 May 2025. Continued use of the Website or participation in competitions after this date constitutes acceptance. The Promoter reserves the right to update these Terms at any time. It is the entrant’s responsibility to review the latest version before entering.

13. Claiming a Prize

  • 13.1 The winner must claim their prize directly and cannot assign or transfer their claim to another party.
  • 13.2 Winners must respond to the Promoter’s notification within 14 days. If the winner fails to respond, the Promoter reserves the right to select an alternative winner.
  • 13.3 Delivery or collection of the prize will be arranged on a case-by-case basis. Additional identification and confirmation details may be requested.
  • 13.4 If bank account details are required for cash transfers, the winner must provide documentation proving ownership within 14 days or risk forfeiting the prize.

14. Limitation of Liability

  • 14.1 Insofar as is permitted by law, the Promoter, its agents, or distributors will not in any circumstances be responsible or liable to compensate the winner or accept liability for any loss, damage, personal injury, or death occurring as a result of taking up the prize, except where it is caused by the negligence of the Promoter, its agents, or distributors or that of their employees.
  • 14.2 Your statutory rights are not affected by these terms.
  • 14.3 The Promoter does not accept responsibility for entries not successfully completed due to a technical fault, malfunction, hardware or software failure, network failure, or other technical issue.
  • 14.4 The Promoter accepts no liability for losses resulting from incorrect prize allocation beyond correcting the outcome where reasonably possible.
  • 14.5 Broader Limitation
    The Promoter is not liable for any indirect, incidental, or consequential loss or damage arising from participation, including economic or reputational impact, except where legally required.
  • 14.6 Post-Prize Responsibility
    Once a prize has been awarded and delivered to the winner, the Promoter assumes no further responsibility or liability. This includes, but is not limited to, any loss, damage, injury, or death resulting from the use, misuse, or enjoyment of the prize. The winner accepts the prize at their own risk and is responsible for any further obligations, precautions, or insurances required.

15. General Conditions

  • 15.1 The Promoter reserves the right to make changes to these Terms & Conditions at any time. The most recent version will be available on the Website.
  • 15.2 If a provision of these Terms is found to be invalid or unenforceable, it shall be severed from the remainder of the Terms, which shall remain in full force and effect.
  • 15.3 The Promoter may cancel, suspend, or amend a competition in the event of any actual or suspected breach of these terms or if required for legal or regulatory reasons.
  • 15.4 These competitions are in no way sponsored, endorsed, administered by, or associated with Facebook, Instagram, or any other social media platform.
  • 15.5 These Terms shall be governed by the laws of England and Wales, and any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
  • 15.6 Changes to Services and User Access
    To improve user experience or meet legal or business needs, the Promoter may temporarily or permanently change, suspend, or withdraw competitions or services. These changes may be made without notice. We aim to act transparently and in the best interest of fair participation at all times.

16. Account Registration & Management

  • 16.1 Participants are responsible for ensuring the accuracy of the contact and personal information held in their account.
  • 16.2 The Promoter accepts no responsibility for missed communications due to outdated or incorrect information.
  • 16.3 Entrants must ensure they have access to the email address and phone number used when entering a competition.

17. Fraud Prevention & Disqualification

  • 17.1 The Promoter reserves the right to disqualify any entrant who:
    • (a) engages in fraudulent behavior or misrepresentation;
    • (b) uses automated scripts, bots, or software to enter competitions;
    • (c) tampers with entry processes or the functioning of the Website;
    • (d) breaches any of these Terms & Conditions.
  • 17.2 Any entries found to be invalid under this clause will be void, and no refunds will be given.
  • 17.3 The Promoter may prevent disqualified individuals from entering future competitions.
